License Agreement

This End User License Agreement ("EULA") governs the use of pontaj.eu applications (mobile - Android and iOS - and desktop - Windows), offered by GlobalEX Software SRL, CUI 25202471 ("Provider"). By installing, accessing or using the Application, you ("User") fully accept this EULA. If you do not agree, do not install or use the application.

1. Grant of License

The provider grants you a limited, non-exclusive, non-transferable, revocable and non-sublicensing license to install and use the application on your devices or those provided by the employer, exclusively for the purpose of using the pontaj.eu service in the employment relationship. The license is conditional on the existence of a valid access, granted through the employer (the Beneficiary).

2. Restrictions

You have no right, outside the limits expressly permitted by law, to: (a) copy, distribute, rent, lend, sell or make available to third parties the application; (b) decompile, disassemble, reverse engineer or attempt to extract the source code; (c) modify, adapt or create derivative works; (d) remove or alter any proprietary notices, copyrights or trademarks; (e) bypass technical security or licensing measures.

3. Property

The application is licensed, not sold. All intellectual property rights to the application and its components remain with the Provider. The data entered or generated by you through the application are not subject to this license and are treated according to the Privacy Policy (https://pontaj.eu/confidentialitate).

4. Updates

The application may receive automatic or on-demand updates designed to correct errors, improve functionality or security. Updates are governed by this EULA, unless accompanied by separate terms.

5. Third Party Services and Components

• Push Notifications: The mobile app uses Google Firebase Cloud Messaging to deliver notifications; Google terms and policy apply.
• Maps (optional, geofence): third-party map/geocoding services can be used for GPS presence verification, exclusively at the technical level required to display the map.
• Software signing: The desktop application is signed with digital certificate issued by Microsoft service.

The use of these third-party components is subject to the terms of the respective providers, the Provider not assuming responsibility for the services controlled by them.

6. Data and Privacy

The processing of personal data by the application is described in the Privacy Policy. The data operator is your employer; The supplier acts as a proxy. The desktop application may store certain identifiers locally (e.g. biometric template, where applicable), without transmitting them to the pontaj.eu cloud server.

7. Availability and Warranties

The Application is provided "as is" and "as available" without express or implied warranties of uninterrupted or error-free operation, to the extent permitted by law. Certain features are dependent on connectivity, device and employer configuration.

8. Limitation of Liability

Within the limits allowed by law, the Provider is not responsible for indirect losses, profit or data, or for the consequences of improper use of the application, of the configurations established by the employer or of the data entered erroneously. Total liability is limited in accordance with the Terms and Conditions applicable to the pontaj.eu service.

9. Duration and Termination

The license is valid until the end of the access granted by the employer or until the application is uninstalled. Upon termination, usage rights cease and locally stored data is deleted upon uninstallation (for the mobile application) or according to the mechanisms described in the Privacy Policy (for the desktop application). The Provider may suspend or revoke the license in case of violation of this EULA.

10. Modification of the EULA

Provider may update this EULA; changes will be communicated via the app prior to taking effect, and continued use constitutes acceptance.

11. Applicable Law

This EULA is governed by Romanian law, and disputes are settled amicably or, otherwise, by the competent courts, unless the law provides otherwise.
